Jumbo Studios LLC ("Company," "we," "us," or "our") provides the PokerChess mobile application (the "App") and related services. By accessing or playing PokerChess, you ("User" or "you") agree to be bound by these Terms of Service ("Terms").

1. Nature of the Service (Social Casino)
PokerChess is a "Social Casino" strategy game intended for entertainment purposes only.
- No Real Money Gambling: The App does not offer "real money gambling" or an opportunity to win real money or tangible prizes based on the outcome of gameplay.
- Skill-Based Gameplay: Unlike traditional slots or games of chance, PokerChess is a game of skill, strategy, and "perfect information" where all cards are visible. Success in the game is dependent on user decision-making rather than pure chance.
2. Eligibility
By using the App, you represent and warrant that:
- You are at least 17 years of age (or the age of majority in your jurisdiction, whichever is higher).
- You are not prohibited from receiving products of U.S. origin, including services or software.
- Your account has not been previously suspended or removed by us.
3. Virtual Currency ("Chips")
The App uses a virtual currency known as "Chips" to facilitate gameplay, including buy-ins for matches and purchasing cosmetic items.
- No Monetary Value: Chips have no real-world monetary value and do not constitute currency or property of any type.
- Non-Transferable: Chips cannot be sold, transferred, or redeemed for cash or prizes. You may not sell your account or your virtual currency to other users.
- Revocable License: Your balance of Chips constitutes a limited, personal, non-exclusive, non-transferable, revocable license to use the currency solely within the App.
- Purchases are Final: All purchases of Chips via the App Store (Apple) or Google Play Store (Android) are final and non-refundable, except as required by applicable law.
4. User Conduct and Fair Play
To maintain the integrity of our skill-based ecosystem, you agree NOT to:
- Cheating: Use exploits, automation software, bots, hacks, mods, or any unauthorized third-party software to modify or interfere with the App.
- Collusion: Engage in "chip dumping" or working with other players to manipulate match outcomes or Leaderboard rankings.
- Elo Manipulation: Intentionally lose matches to lower your Elo rating artificially.
- Abuse: Harass, threaten, or defraud other users or Company staff.
Violation of these rules may result in the immediate suspension or permanent banning of your account and forfeiture of all virtual currency without refund.
5. Matchmaking and Gameplay Rules
- Disconnects: If you disconnect during a match, a reconnection timer will begin. Failure to reconnect within the allotted time will result in an automatic forfeit and a loss of the match buy-in and Elo rating.
- Lane Locking: Once a lane reaches 5 cards, it is permanently locked. You acknowledge that game rules regarding card placement and discarding are enforced server-side and are final.
- Sudden Death: In the event of a 2-2 tie, the match enters "Sudden Death," and the winner is determined by the remaining cards in your hand. This result is final.
6. Intellectual Property
The App, including its code, graphics, "PokerChess" name, game mechanics, and audio, is the proprietary property of Jumbo Studios LLC. You are granted a limited license to access and use the App for your personal, non-commercial entertainment.
7. Disclaimers and Limitation of Liability
- "As Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the App will be uninterrupted or error-free.
- Limitation of Liability: To the fullest extent permitted by law, Jumbo Studios LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the App.
- Beta/Updates: We reserve the right to modify game mechanics, economy balance (e.g., rake percentages, buy-in amounts), and features at any time without notice.
8. Governing Law
These Terms shall be governed by and defined following the laws of the State of Georgia, United States. You irrevocably consent that the courts of Georgia shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
